Unhealthy Premises

The Public Health Act 1997 provides powers to Council to assess and if necessary regulate unhealthy housing. Council have the power to issue Rectification Notices and if required Closure Orders under the Act.

However, in doing so Council does not become involved in tenant /landlord disputes with these actions properly resolved under the Residential Tenancy Act 1997.

When required, Council officers will assess living conditions resulting from building defects or lack of facilities. Issues such as personal hygiene standards are not covered by the ambit of Council’s powers under the Act. A common issue that is raised with Councils is the occurrence of mould in winter months. This is quite often the result of the occupant not being aware of the causes of mould growth.
